MINUTES OF THE ALBANY VILLAGE BOARD
April 12, 2010
The regular meeting of the Albany Village Board was called to order at 6:30 p.m. by President Larry Hanson in the Albany Village Hall. Members present were: Hanson, Virginia Detra, John Briggs, Rod Sutherland, John Grochola, Peggy Boeck, and Wayne Stemple. Also present were: Bob Levitt, Danny Mueller, Lisa Bloedel, and Tony Wickersham.
The Pledge of Allegiance was shared.
Proof of posting was verified.
AGENDA: Motion by Briggs, seconded by Grochola to approve the agenda as posted. Carried.
MINUTES: Motion by Boeck, seconded by Sutherland to approve the minutes of the March 8, 2010 meeting as printed. Carried.
PRESIDENT’S MOMENT: Nothing at this time.
PUBLIC APPEARANCES: Tony Wickersham asked to read a speech of his intentions to running for State Senate for the 27th District. The board thanked him for his time.
ARBOR DAY PROCLAMATION: Stemple announced that we need to proclaim April 30th, 2010 as Arbor Day in the Village of Albany as part of the requirements for the Tree City USA Designation. Motion by Stemple, seconded by Sutherland to approve the Arbor Day Proclamation. Carried.
EMERGENCY MANAGEMENT CHAIN OF COMMAND: Hanson explained that there is a new law that requires a chain of command be listed that is four people deep in the case of an emergency. Obviously, the president is the first on the list, but since villages do not have any other officers listed on their board, we will need to decide how this should be done. Hanson is looking for input on who would be named – such as would it be by positions on committees/commissions or would it be by person. It was suggested that there should be some consideration in anyone who has had any training, so the consensus was to choose those who have had training and/or experience.
ANNOUNCEMENT: SPRING ACCEPTANCE DAY: Grochola explained that the date for the Spring Acceptance Day has been set for May 1, 2010, and that the medicine collection will be held the following Saturday – the 8th. There will be no curbside pickup this year, only two acceptance days. It was also reminded that residents will be allowed to bring in up to 8 bags of garbage – do not need to purchase yellow or green for these.
WORKHORSE CONFERENCE: Keepers explained that there is a conference for the Workhorse software on the same day that Keepers will be gone to another meeting. She

feels that Michelle Brewer should really attend this one day conference, as Workhorse has the Accounting, Payroll, and Utility programs that we use all of the time. This conference will allow her to find out about all of the updates and get answers to questions that we have. Motion by Detra, seconded by Stemple to allow Michelle Brewer to attend the Workhorse Conference on April 23rd at a cost of $40 and to allow the office to be closed for that day. Carried.
FIRE DEPARTMENT UTV: Hanson explained that he found that the village has an ATV ordinance on the books right now that does not allow them to be driven on any village streets. The fire department has purchased a UTV, but after investigating the laws further, at this time the UTV’s are considered ATV’s and therefore need to follow the same laws. Chief Mueller stated that they mostly wanted this vehicle for river rescues, and feel that having to trailer it to a scene will take additional time. This vehicle will do 45 mph, and they have already put lights and sirens on it. Hanson explained what he had been told from the DNR and State Patrol, and if the village were to adopt an ordinance to allow it, they must allow all ATV’s on the streets. After more discussion, a motion by Briggs, seconded by Detra to leave the village’s ordinances as they are at this time. Carried.

HANDICAP PARKING ON SOUTH EAST STREET: Briggs explained that the resident of 300 South East Street had attended the Police Committee meeting requesting that a handicap parking space be designated by their home, as her husband is handicapped and they have trouble getting him into the house. Motion by Briggs, seconded by Boeck to designate a handicap parking space in front of the residence located at 300 South East Street. Carried.
CONDITIONAL USE PERMIT FOR NUMBER OF ANIMALS: Motion by Hanson, seconded by Stemple to grant a Conditional Use Permit to Amanda Thompson and Ian Henderson for the property they are purchasing located at 414 South Mechanic Street to allow no more than four (4) horses be kept at this property at any time. Carried.

FENCE PLAN: Motion by Hanson, seconded by Briggs to approve the fence plan for approximately 72’ of decorative fence on the south side of 302 North Mechanic Street (Lisa and Jeremy Nickols property). Carried.
CRACK SEALING IN THE VILLAGE: Motion by Sutherland, seconded by Stemple to accept the crack sealing bid from Bartelt Enterprises, Inc. for South Water Street and Fourth Street (East from Cincinnati Street and corner of Main and East) with a total cost of $1,143.00. Carried.
BILLS: Motion by Stemple, seconded by Boeck to approve the bills as explained. Carried.
CONCERNS AND FUTURE ITEMS: Stemple reported that we had received a letter stating that we have again received Tree City USA Status.
Stemple reported that approximately 110 students of the middle and high school will be coming to the village to do some outdoor projects around the village on April 22nd.
Briggs recommended that the Plans Commission should review the property at 403 Mineral Street as needing improvements. They started siding the home, but have left it and now the insulation is blowing off.
Sutherland explained that the street committee is waiting for some bids for street work. They are hoping to do work on South Summit Street and Union Street. Briggs stated that he has driven on Union Street and it is in horrible shape. There is also a driveway that extends out onto Summit Street that can be a traffic hazard. This will be reviewed further.
Sutherland stated that there is a continuous mess that keeps “growing” in the back alley next to the book store. This also needs to be addressed at the Plans Commission meeting.
ADJOURN: Motion by Briggs, seconded by Stemple to adjourn. Carried.
