December 12, 2009

The regular meeting of the Plans Commission was called to order at 6:30 p.m. by President Larry Hanson in the Albany Village Hall on Thursday, December 12, 2009. Members present were: Hanson, Virginia Detra, Wayne Stemple, Mark Riedel, and Peggy Wetter. Absent were Eileen Althaus and Jeff Berra. Also present were: Bill Briggs, Robert Johnson, Danny Mueller, Eowyn Brewer and Kevin, and Todd Schluesche.

Proof of posting was verified.

MINUTES: Motion by Stemple, seconded by Detra to approve the minutes of the previous meeting as printed. Carried.

600 REUBEN’S CAVE DRIVE DECISIONS: Hanson opened up the discussion by asking village attorney, Todd Schluesche, to explain his findings regarding the concerns over running a business of selling horses on the property located at 600 Reuben’s Cave Drive. He stated by citing ordinances 74-13 regarding animals in the village, and also 273-20 regarding the zoning issues. He explained his findings in that there is a narrow difference which was difficult to separate. However, his final findings were that according to the AG zoning, Eowyn Brewer was running a business on this property by selling horses, and it was not listed as allowable in the current ordinances. He explained that there are no descriptions in the ordinance for stable, paddock, and farming, so he had to use the descriptions in a dictionary. After explaining those descriptions, he stated that even thought it was very close, he did feel that they were in violation of the existing ordinance, but also suggested that the village may want to address these ordinances to clear up these discrepancies. Items discussed were the village’s comprehensive plan that we were trying to be in compliance of; whether the village wanted to change the ordinances to allow a Conditional Use Permit if someone wants to raise and sell livestock or horses; also questioned were the number of horses on this property; the difference between raising or selling horses or whether or not they are being sold from this property. After much more discussion, it was decided that we need to clear up the existing ordinances before any more can be done at this time. The village will keep Brewers informed on this process so that they can be a part of it if they want. The commission thanked them for coming and Brewers and Schluesche then left.

AIRPORT ASSOCIATION REQUEST: Bill Briggs and Robert Johnson were present to as for the village’s approval of the extraterritorial zoning of the airport so that the association can apply for a conditional use permit to allow building of more hangars. After some explanations and questions, a motion was made by Detra, and seconded by Stemple to approve the Albany Airport Association’s request for a Conditional Use Permit. Carried. Keepers will draft a letter after the board approves this.

ALBANY FIRE DEPARTMENT LAND USE: Danny Mueller was present to request the use of some land next to the recycling center for the fire department to use for training. Concerns were if there is a problem with insurance; what type of structures will be on the property; and is this sellable land. It was decided that there would be room on the village’s land that is currently housing the recycling center and brush pile and salt shed. Motion by Stemple, seconded by Hanson to recommend to the board that the Albany Fire Department be allowed to use a section of land in the Industrial Park for training. Carried.

FENCE PLANS: We have no fence plans at this time.

FUTURE AND OTHER BUSINESS: Keepers explained that she had received a call from a man from Wisconsin Management that stated that the Albany Arms Apartments is being sold, and the new owners are requesting a statement from the village regarding the setbacks on this property. When they had a survey done, it did not show any setbacks. They are asking that a letter be sent showing the setbacks, and stating that if the setbacks are not being met by this existing building, the village will consider it legally permitted nonconforming use and will not require them to make any changes. The commission had some questions, but after discussion agreed that the letter should be sent.

Stemple asked that the Commission consider a clarification of the village’s description of a business. There are several types of jobs that people do at their home that are not considered an actual business, but the ordinances do not clarify that. It was agreed that this is something to be done soon.

Riedel stated that he read through the ordinances that the attorney had at tonight’s meeting, and he feels that they are ok. They will be reviewed.

Detra questioned the height of the new building being built at the Brian Hauri property located at 302 North Cincinnati Street. It appears to be taller than approved. Keepers researched old minutes and found that the board approved a variance for Hauri to build the building no more than 25’ tall.

ADJOURN: Motion by Detra, seconded by Stemple to adjourn. Carried.
