PLANS COMMISSION
March 4, 2010

The regular meeting of the Plans Commission was called to order at 6:30 p.m. in the Albany Village Hall by President Larry Hanson. Members present were: Hanson, Virginia Detra, Eileen Althaus, Jeff Berra, Peggy Wetter, and Wayne Stemple. Absent: Mark Riedel.

Proof of posting was verified.

MINUTES: Motion by Stemple, seconded by Detra to approve the minutes of the previous meeting as printed. Carried.

JKJB LETTER OF CREDIT: Hanson explained to the commission members that the letter of credit we had received for the Riverview Heights Subdivision is expiring on April 1, 2010. The original letter of credit was in the amount of $240,000. Since this phase of the work was complete, the only thing that is owed to the village is the cost for the storm water fees. This amount comes to $46,044.70, plus there is a balance due of $222.50 to the village for the cost of engineering fees. Keepers presented the members with a model letter for them to critique and change as needed that we will send to the developers explaining that we will allow the L of C to be lowered to $50,000 from the $240,000, but unless the developers want to pay up this amount, we will still require a Letter of Credit. The commission read through the letter and made some changes. Motion by Stemple, seconded by Berra to approve sending the letter as amended. Carried.

PROPERTY AT 304 SOUTH MECHANIC STREET: Keepers explained that she had received a phone call from the property owner of 304 South Mechanic Street stating that they would like the property condemned, as they are having some problems with their disability payments. The commission is concerned over the costs that the village would incur with this process, and reminded everyone that once this process is started, there is no stopping it. After more discussion, Hanson asked for a motion on this matter. Hearing none, there will be no action at this time due to the lack of a motion.

ANIMAL ORDINANCES: The village’s attorney reviewed our ordinance recently adopted regarding the number of large animals on Ag land in the village. Each member present was given a copy of the letter from the attorney and the recommendations he is making. Hanson asked that each member take this copy and review it for the next meeting so we can decide at that time what steps we want to take.

FENCE PLANS: There were none.

APRIL MEETING DATE: The April Plans Commission meeting will be held on Thursday, April 1, 2010.

FUTURE ITEMS: Keepers announced that she received a request from some people looking to purchase the property at 414 South Mechanic Street for a public hearing to allow them to have horses on this property (that is zoned ag). This hearing will be held at the April meeting. Other items to be discussed at the April meeting are: the animal ordinance, and the weed commissioner wants some direction from the commission for his job.

ADJOURN: Motion by Berra, seconded by Detra to adjourn. Carried.
