PLANS COMMISSION / COMMUNITY DEVELOPMENT
October 7, 2010
The regular meeting of the Plans Commission/Community Development Committee was called to order at 6:30 p.m. in the Albany Village Hall by President Larry Hanson. Members present were: Hanson, Virginia Detra, Jeff Berra, Mark Riedel, Eileen Althaus, Peggy Wetter, and Wayne Stemple. Also present were: Mr. and Mrs. Todd Morrison, Mr. and Mrs. Damien Babler, Mr. and Mrs. Wayne Nipple, and Tim Magee.
Proof of posting was verified.
MINUTES: Motion by Stemple, seconded by Detra to approve the minutes of the previous meeting as printed. Carried.
PUBLIC HEARING/RECOMMENDATION: Hanson called the public hearing to order to consider a Conditional Use Permit for Todd Morrison to be able to do car repairs at his home located at 300 Reuben’s Cave Drive part time. There was no one present in regards to the hearing. Keepers reported that one neighbor, John Hlavachek, stopped in the office and stated that he has no problem with the Conditional Use as long as there are not a lot of cars always parked around the property making it look like a junk yard. After some discussion, a motion by Detra, seconded by Stemple to recommend granting a Conditional Use Permit to Todd Morrison for his home located at 300 Reuben’s Cave Drive and that he make sure that there are not too many vehicles parked around and providing that all state and DNR approvals received are brought to the village. Carried.
CHICKENS IN R-1 DISTRICT: Bablers were present to request permission to have 8-10 chickens on their property located at 212 Warren Street which is zoned R-1. The chickens would only be for personal use. Berra spoke as a neighbor to this property, and has no problems with the chickens that are there. Detra feels that by allowing it for one, we would be opening up for other requests. Hanson stated that he didn’t feel that it would be right to make any recommendations without holding a public hearing. Bablers were concerned that they were given a time limit on removing the chickens from the police department, and if they wait for a public hearing at the next Plans Commission meeting, they would be in violation of the order. After more discussion, a motion was made by Riedel, seconded by Stemple to ask the police department to extend the deadline to allow Bablers to apply for a public hearing and to set up for a public hearing at the next Plans Commission meeting. No – Wetter, Detra, Hanson. Carried.
WAYNE NIPPLE REQUEST: Nipples were present to request that a property that they recently purchased located at 206 North Mechanic Street was originally listed with two parcels, however has been changed back to one parcel. Nipples are looking to be able to separate this lot again, and to only sell the front lot that includes the house and buildings. Several concerns were expressed regarding the second lot then being land-locked. They did not feel that it would be landlocked, as it could be attached to their son’s property located directly to the south of this lot. Several on the board then stated that they would have no problem with selling them separate as long as the rear lot was then attached to their son’s lot. After more discussion, they stated that they did not want to be forced to do that that this time – they just want to be able to separate the two. After more discussion, Wayne Nipple stood up and stated that they are withdrawing the request and left the meeting. No action taken.
INDUSTRIAL PARK LAND: Plans were reviewed for the Collinwood building planned for the Industrial Park and it’s layout on the surveyed property that they are to purchase. The plans all appear to be in order, and the village’s attorney and Ekum Abstract are currently working on getting the paperwork for the property ownership changed, so this should all be done in a week or two.
FENCE PLANS: There were no plans to approve this month.
FUTURE ITEMS / OTHER ITEMS: Keepers reported that the building inspector clarified that the property located at 405 North Mechanic Street owned by Mark Flood that was reviewed for a variance last month will meet the attached garage requirements by having a deck between the house and the garage, so he did not need to come back before this committee.
Keepers stated that Doug and Joyce Stephenson asked what they could do regarding the mobile home on the property located at 600 West Main Street that her granddaughter is purchasing. The mobile home is in extremely bad condition, so they would either like to remove the old and bring in a new or they would like to try to fix up the old one to live in. After some discussion, the commission did not feel that there should be a mobile home on this property, as they are only allowed on mobile home parks. Another concern is since there is a private sewer system on this property, they will need to make sure that this meets all requirements before any permission would be allowed.
Update on the conditional use permit request from last month’s meeting – we have not heard any more from them, as they need to meet the requirements from the county zoning office on their sewer system. N action needed at this time.
