September 2, 2010

The regular meeting of the Plans Commission/Community Development Committee was called to order at 6:32 p.m. in the Albany Village Hall by President Larry Hanson. Members present were: Hanson, Eileen Althaus, Virginia Detra, Wayne Stemple, Peggy Wetter, and Jeff Berra. Absent: Mark Riedel. Also present were: Jennifer Wohlbier, Mark Flood, and Carrie Walters.

Proof of posting was verified.

MINUTES: Motion by Stemple, seconded by Detra to approve the minutes of the previous meeting as printed. Carried.

PUBLIC HEARINGS: Hanson called the first Public Hearing to order to hear a request for a variance from Mark and Julie Flood for their property located at 405 North Mechanic Street. Flood explained that they want to build an addition on the north side of their existing home that would put two 10’ rooms on the home. Currently, their home is approximately 20’ from the property line. To put this addition on, they would be infringing on the setback of the north side of the property. Although he doesn’t feel that they will need the entire requested amount of having only a 5’ setback from the north side, he felt that it would give them a foot or two leeway on where the line would be. But in no way would it infringe any closer than the 5’. After much discussion and questions, a motion was made by Stemple and seconded by Detra to recommend the variance for a setback on the north side of 405 North Mechanic Street to no less than five feet (5’) from the property line to build an addition on the north side of their home. Carried with Althaus abstaining.

The second portion of this hearing is to consider a variance or a clarification on the definition of an attached vs. an unattached garage that would be built in the front of the existing home at 405 North Mechanic Street. Flood has requested building a 30x24’ garage on the east (front) side of their home. However, the way that the original house is built would make it near to impossible to attach the roof to the existing home. Village ordinance does not allow an unattached garage to be built in front of the home. Keepers and Flood both spoke with the building inspector, Dave Wartenweiler, and asked what is considered to be an attached garage. He said that the roof must be attached, but that the entire garage does not have to be attached. However, there are two other items that must be followed: there must be 4’ footings in the ground for the attached garage, and there must be a firewall in the garage for any area of the garage that is 10’ or less from the home. Much discussion was held on the clarification of the attached question, and it was then decided that Flood and Keepers get more information and bring this back to the commission at their next meeting before any decisions are made. This item is tabled.\

The second public hearing was then called to order. This hearing was in regard to 706 Vine Street. The new renter is considering putting in a small hair salon and since it is zoned agricultural, it would require a conditional use permit to allow a business to be run.

Jennifer Wohlbier is renting this property from Lois Hannes, and is requesting a conditional use. She explained that there is a 10x13’ room that is already in this home, and it has a separate entrance and separate bathroom. She stated that it already meets her needs. She currently is running a hair salon in her home in Monroe. Hanson stated that he is concerned over the septic on this property, as it is not attached to the village utilities. Hanson stated that there are new rules on the condition and size of a septic for different types of uses – such as commercial. He recommended that Wohlbier and Hannes’ speak with Adam Wiegel, Green County Zoning Administrator, to make sure that they are in compliance. She is then to bring in proof that the county has no problems and the commission will address this then.

Motion by Berra, seconded by Stemple to close the Public Hearing. Carried.

RECOMMENDATIONS FROM THE PUBLIC HEARINGS: The first public hearing for the side lot line variance at 405 North Mechanic Street recommendation: Motion by Stemple, seconded by Detra to approve a variance on the north side of the property located at 405 North Mechanic Street currently owned by Mark and Julie Flood to allow them to build an addition on the existing home that would be no closer than five (5) feet from the north property line. Carried.

The second portion of this public hearing in regards to the garage on the front of the existing home located at 405 North Mechanic Street recommendation: This was tabled, as there is more information regarding the description of attached or not attached garage. If it would be considered attached to use a patio to attach it instead of a roof attachment, they will need no variance. More information will be brought to the next meeting.

The second public hearing regarding the Conditional Use request for 706 Vine Street recommendation: This item is tabled until the information regarding the septic at this property and the zoning department at Green County are all in agreement.

FENCE PLANS: Hanson requested to go out of order of the agenda so that the renter who is requesting a fence plan was not required to sit through the entire rest of the meeting. The property located at 109 School Street is requesting a fence plan approval for a 4.5’ picket fence to be added to the rear yard of this location to separate their dog and the school children. A drawing was reviewed, and discussion was held. Due to not having anything in writing from the property owner, the commission felt the need to have this before making a final decision. Motion by Stemple, seconded by Detra to approve the fence plan contingent on getting something in writing from the property owner. Carried.

INDUSTRIAL PARK: Hanson explained that he has met with the engineers regarding the lot to be separated off in the business park for the purchase by Louann Harmel. He

and Runaas also met with Harmel and explained the entire situation to her. All seem in agreement, and a preliminary certified survey map was reviewed. However, to keep the property completely out of the flight path of the airport, it would be more like one acre of land instead of the original acre and a half that Harmel was requesting. The price would also have to be adjusted to accommodate the lesser amount of land. After some discussion, a motion was made by Detra and seconded by Stemple to recommend the approved of the certified survey map and to decrease the cost of the lot to Harmel to $12,000.00 due to the change in size. Carried.

FUTURE ITEMS: There were none.

ADJOURN: Motion by Stemple, seconded by Berra to adjourn. Carried.
